The Provision of Women’s “Rights” and “Roles”

After Japan’s defeat, women’s legal rights were promoted under the reforms by the General-Headquarters of the Supreme Commander for the Allied Powers (GHQ-SCAP). Women’s suffrage was granted in December 1945, and 39 female members of the National Diet were elected in through the general election held in April 1946. The new Constitution stipulates individual dignity and the essential equality of the sexes with regard to matters pertaining to marriage and the family (Article 24). The Civil Code abolished the family head system, while the Penal Code abolished criminal speech. Moreover, the Fundamental Law of Education also stipulated that the equal opportunities of receiving education shall be given regardless of sex. In this way, the foundation of gender equality was built, which provided women many more options in their lives. Problems remained, however, including the preservation of the Family Register Act.
